As long as he is not on aprole or probation, then yall can take him anywhere. You may want to talk to the Costa Rica consulate and make sure they will let him in to the country.

That means a 10 year sentence does not have to be served but 10 years of probation will be served instead. If the person mess up the probation, then they can get 10 years in prison.
