What are my chances of having a petty theft case dismissed and not on my record?

Answered by attorney Dennis Julian Roberts (Unclaimed Profile)
Criminal Law lawyer at Dennis Roberts A Professional Corporation
IF your lawyer negotiates with the DA you MIGHT be able to get it reduced to some sort of infraction which then is not on your record. But if you can't get an infraction do NOT plead straight up to a petty theft as not only will it go on your record but if you get busted for another petty in the future they can charge it as a felony if they want. It is called a Petty with a Prior.

Will my dismissed conviction still show other data on a background check?

There is no such thing as one singular criminal record. Many companies carry a data base. The info carried varies from one to the other. Most carry date of arrest, date of charge and date of conviction ( plea of guilty or no contest )

How can I help my friend who is in jail and his public defender won't tell him anything?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
Unless you are an attorney, there's nothing you can do to help. If you can afford to hire one, then that's what you need to do. If that's not possible and he's not happy with the public defender, he needs to make a Marsden motion, which is a request for a new court-appointed attorney.
