Can a felon be charged with having a gun if a gun was found where they live but they were not present and the gun is not theirs?

One can always be arrested.? They would have to prove that the felon was at the premises when the gun was there.? He can be charged even if it is not his as he can have joint possession; ownership does not matter.

Can I continue to pursue a civil case if the DA threw it out due to small inconsistencies in the formal statement?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You can try and hire a special prosecutor. Basically find an attorney in your area who used to be a prosecutor and that person will help you get charges accepted and may even prosecute the case.

What is a way to get him released without costing me an arm and a leg before setting the court date?

Answered by attorney Michael L. Aaronson
Criminal Law lawyer at Aaronson Law Firm
The bond sounds very high and probably "excessive" for the crime he's charged with. He has a right to a bond hearing very soon after his arrest and probably should have gotten an attorney, court-appointed or otherwise, to handle these matters.
