When you're arrested and your Miranda rights are not read to you, will the case still stand?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
The failure to read Miranda rights to a person in custody who is interrogated (only time it applies) results in the suppression of those statements only. It does not mean the case will be dismissed. And, any questions when the person is not in custody but an investigation is being conducted or the person blurts out without being interrogated are admissible anyway.

What happens if there is new evidence concerning my appeal?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The newly discovered evidence is critical in getting a new trial on appeal. Your appellate lawyer should be able to modify the appellate filing to include the new information or file an out of time appeal if necessary. Ask your attorney about filing ASAP so the incarceration will not start. It seems that the mandate must have been received from the appeal and that will start the incarceration.

Is it possible to keep employers form seeing my felony?

Thomas J Tomko
Answered by attorney Thomas J Tomko (Unclaimed Profile)
Criminal Law lawyer at Thomas J. Tomko, Attorney at Law
If your case is completed, then your only option to keep the conviction from someone who reviews your record is an expungement, if you are eligible. If your case is not completed, you should hire an attorney and ask which of the several options to keep something off your record might be available for you. There are provisions for convicted felons to hunt, for example. Once again, you should hire an attorney to look into this for you.
