Generally at the risk of loss caused by an intervening criminal event, in this case the theft, is that your legal liability. I would suggest you confer with attorney with the details.

The police and prosecutor will argue that you were in constructive possession of the firearm. In order to show constructive possession the prosecutor need only show that you had dominion and control over the contraband or the premises where the contraband was located.

You should get a lawyer to try to get this dismissed. There are oftentimes ways to get the charge cases dismissed in such circumstances. You really do not want a theft conviction on your record, as it looks ugly to potential employers.
