The clerk said now I must plead not guilty and go in front of the DA, do I need an public defender for this matter?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You MUST hire an attorney. And a different attorney that you friends. Your attorney will protect you. Galveston is a good county to be in trouble in. Hire an aggressive trial attorney. I work down there, but tell you the case would be at least $7K to hire me. If you can't afford that, try Chris Samuelson.

Will I go to jail for shoplifting?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You could go to jail. Or worse, be labeled a thief for the rest of your life. You absolutely need to hire an attorney and do NOT plead guilty to theft. Ever.

Your option at this point is to seek a post conviction remedy. Given the facts you've described, it might be possible to go after the conviction on the basis of ineffective assisof could counsel. But, to know whether it's possible for sure, you'd need to have a sit down discussion with an attorney.
