CAN I GET OUT OF A SUBPOENA

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
Since you have been subpoenaed, you must appear as ordered.  However, if you have sufficient legal grounds, you can file a motion to quash subpoena and ask for a hearing (it needs to be before the date you are supposed to appear).   Although you do not have to have an attorney with you when you to to talk to the State Attorney, I strongly urge you to consult with an attorney ahead of time -- and, in my opinion, have him/her with you if the State Attorney's Office is in the investigative stage of a case that has not yet been filed.  (Even if the case is one that already has been filed -- and you have been subpoenaed to give a deposition, you may want to consult with a lawyer before giving your deposition.  That will depend to a large degree on what involvement you had in the case or with the person who was charged.)   Whether you have any legal grounds on which to seek to quash the subpoena is something an attorney should be able to determine after discussing the facts of your involvement or knowledge with you.
