What can I do if a person is saying I raped her 2 years ago?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
I would not talk to the police without an attorney present. It is very easy to hurt yourself if you aren't familiar with the law. You have some good facts on your side like that you have never had sex and this alleged to have happened 2 years ago.

You are really learning. SO, I cannot imagine that judge will not put you in jail. And you seem bright, because I can understand your question, and it is written in English. SO, I cannot help but guess that you have a problem with alcohol or drugs.

What happens if I just got arrested for drug paraphernalia while on probation in another state?

Jared Clayton Austin

Criminal Law lawyer at Austin Legal Services, PLC
There is certainly a good chance of it. It will depend on how the judge usually handles these matters, if it is your first violation, and what your probation officer is recommending. They could extend your probation, add to your conditions, or revoke your probation and re-sentence you up to the maximum amount for the original offense that placed you on probation. A lot is at stake so you need to be represented by an experienced criminal attorney that handles probation violations in your area who will be familiar with the judge and your probation officer. Keep in mind, that the standard of proof for probation violations is much lower than trial. They only need to prove your guilt by a preponderance of the evidence.
