What happens if my husband was driving my truck under my name, did not stop, run away and got charge with evading arrest?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
Hire a lawyer to represent you. The truck may be community property between you and he, and there will be a question of actual ownership if your mother?is on the title just to be a co-signer.

Will my brother do a lot of time if he is charged with intoxication assault, but his blood drug/alcohol test shows he was below the .08%

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
It depends on what the blood test results are. They test for more than just alcohol. If there were prescription drugs and/or illegal drugs, the fact that his blood alcohol content was below .08 will not matter, in terms of whether he will be prosecuted. However, be sure he hires a very good DWI lawyer to represent him. Alcohol in the blood should not be looked at the same way as drugs in the system. Mere presence of drugs, or the metabolites of drugs, may not be enough to convince a jury that he was legally intoxicated.

What are the advantages to hiring an attorney for a Class C Assault case?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Class C is a very small case. You absolutely need an attorney for a Class A. but honestly, on a Class C, go talk to the prosecutor and ask 1. That he dismiss it, please, and 2. Give you deferred adjudication probation. Then successfully complete the deferred and call an attorney to seal that case.
