Simple assault is handled in municipal court. However, if you plead guilty or are found guilty then you could be summoned for a violation of probation hearing. Several things could happen at the hearing, including a jail sentance. Or nothing could happen, if you're lucky. You will definitely want to retain an attorney to assist you in this.

There is a lot of case law on this area and it can be argued either way. If you were not charged with a crime there is no issue to argue. The police can approach you and ask for ID. The police can also do a Terry search (pat-down) for their own protection. Also, Probable Cause is what is needed for an arrest. Were you arrested? If you were arrested the police can search you. If the police searched you, then arrested you based on what was found in the search there may be an issue. If you were arrested and charged with a crime you need an attorney to evaluate your case.
