Is it legal for a pest control company to break into your condo before fumigation?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
Why did you ask this as if it were a criminal defense question. I suppose the company would have a contract which allows them to enter the premises without threat of being prosecuted criminally.

Can two people be charged with the same crime if one person already took the charge and went to prison?

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
Yes, there are numerous ways in which more than one person can be charged with the commission of a crime involving the same incident - even if one person already has been convicted  of some offense in that incident.  Since you already have been arrested, I assume you have an attorney.  You need to discuss this with your attorney.   If you do not have an attorney, because you mistakenly thought you didn't need one since someone else already has been convicted and sentenced, I would urge you to consult with an attorney ASAP -- and before talking to any law enforcement officer.  Remember, you have a right to remain silent - even when you're completely innocent.

Who can drop a criminal charge?

Answered by attorney Stephen D. Hebert
Criminal Law lawyer at Stephen D. Hebert, LLC - Criminal Defense DWI Attorney
In short, the decision to drop a charge is solely the District Attorney's decision to make. However, the District Attorney normally will take the alleged victim's wishes into account before making any decision. However, many District Attorneys have recently changed their policies to proceed with domestic violence charges, even when the alleged victim wants all charges dropped.
