What is the benefit of filing a sexual assualt case after 8 years has gone by?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You can make a report still if you want to. Rape is 10 years from the outcry. So with kids, it is from when they remember, but you remembered immediately, so it's 10 years from 2003. You need to contact an attorney in your area. If he is charged with rape, then he will not be able to see you or yalls child. This is a very serious charge to allege. Don't use this charge if you are trying to punish him in a custody battle.

How can I request a reduction in bail when my pro bono refuses to give me her land-line phone number or business addres

Answered by attorney Mark R. Thiessen

Unfortunately there is no rule that attorney give out their phone number. Also, the attorney is working for free, so probably not going to be real responsive. You can always hire an attorney.

My son is currently sentenced to 40 years in california prison his appeal just got denied in the 9th distric, can he i do anything else?

Answered by attorney Patrick Short

You should seek the advice of an appellate attorney who does federal appeals.  It sounds like this just occurred, the decision by the 9th Circuit Court of Appeals just occurred.  There are deadlines so make sure you seek the advice of an attorney so that they can give notice of appeal to protect your son's ability to appeal.  DO NOT DELAY as there are strict timetables for the right to appeal. Good luck...
