Can I get away with self defense if I killed 3 gang members that jump me?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
You don't get away with self-defense. First, the DA makes a decision on whether to charge you with murder. If you have no prior record, and test negative for drugs and alcohol in your system at the time, and have a good explanation for how you came into contact with the gang members, then you might not be charged with murder. If the DA charges you with murder, and you retain the right attorney, then you might be found not guilty by a jury. If you deliberately put yourself in a situation where any reasonable person could see you were asking fro trouble, then you might end up in prison for 35 years. Then you can kill as many gang members as you want.

What can I do about my warrant for a misdemeanor marijuana charge?

You can wait for them to arrest you. You can turn yourself in and be further prosecuted for smoking a herb. Or you can pay a bloodsucking lawyer to try and get the warrant recalled.

Is it legal or does she have a case of unlawful arrest?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)
Criminal Law lawyer at Law Office of Joe Dane
Miranda rights only come into play if she is in custody (arrested) and being questioned. It's not like TV where she has to be read her rights at the moment of arrest.
