What evidence is needed to file a Domestic Violence Restraining Order?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)
Criminal Law lawyer at Catchick Law, P.C.
Most Courts want to see at least 2 separate and distinct instances of violence or threats of immediate violence before they will grant a Personal Protection Order. Therefore, I would strongly recommend you keep a written log or journal, noting the exact date and approximate time of all his threats or violence. After he does it 2 or more times, go to Court and request the Personal Protection Order.

Stop and identify. I was walking in my neighborhood and a police officer stopped me. He said I matched the description of a suspicious person report

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
This is not a reasonable stop. Probable cause is required to stop someone and demand identification. This does appear to be profiling if there has not been a report of a crime or suspicious activity and the person stopped is a minority or a member of a protected class. If an arrest is made, any evidence that is obtained may be subject to suppression.

Is there a statute of limitations for lying about your age in court?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Why would someone report it. I guess technically she could, but there are defenses. And it would have to record or transcribed.
