If you are the driver, you are responsible for all passengers and the content of your vehicle. However, lack of knowledge may be a defense. There are a number of michigan cases which would result in a dismissal for the driver where a passenger or unknown person ditched their drugs in the car after the police pulled up. The facts will lead to whether or not there is a good defense.

If she's serving time for multiple cases concurrently, be aware that she cannot apply credits from one case to another. That is a common mistake people make when trying to calculate release dates. She may have had a large amount of credits built up for some cases, but that does nothing against the time she has been sentenced to in her new case. I would suggest that you contact her lawyer to have him or her double check the released date.

If your time to file an appeal hasn't expired, you are free to do so. However, I would suggest retaining a lawyer who specializes in appeals to review your case to determine what claims to raise and if you can prevail. Also, be patient. Appeals take time and can get expensive.
