What can I do if I'm on probation and missed my court date for drug paraphernalia?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
If you have a paraphenalia charge and your probation officer finds out about it (or if you are required to report any tickets / arrests / contacts with police - look at your terms of probation to see) or you don't tell your p.o., then you could get a MTR. The law violation is more than sufficient to trigger a MTR. Failing to appear will result in a warrant - another headache. You need to get a lawyer and get on top of your situation.

My record indicated I was convicted for theft by check

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
If the court was a county or district court there should be a judgment that you can see at either the county clerks office or the district clerks office. It will reflect the type of disposition that was entered. If the disposition was deferred probation you may be able to get a non-disclosure order  or an expunction (if the offense was a Class C misdemeanor). In any case the record should be available for you to view and obtain a copy.  Based on the amount of fine ($2000) I would expect that this was a felony. If so, you may have been given a pre-trial diversion. If so, you may not been convicted. A non-disclosure order is also available for this type of disposition.

Can I apply for my citizenship in Texas without a layer following deferred adjudication?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You can only seal it with a Petition for Non-Disclosure. Get that done asap. And then speak with an immigration attorney in your area about applying for citizenship. You may have some problems depending on your unique circumstances, so best to consult a professional.
