If I got my criminal record expunged does that mean I do not have a criminal record anymore?

Even if you get a conviction expunged from your criminal record, law enforcement will always be able to see that you were charged with a crime and it was expunged. So, if you apply for a federal job, you should assume that they will have access to that information.

Can the police ask to search my home on hearsay?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
Did they get a warrant? I assume that they did, since you failed to mention it. They can come to your door on hearsay. When they smelled the marijuana while at your door, they were able to articulate probable cause for the search warrant. The person that provided the hearsay has nothing to do with nothing after the police smell marijuana and get a search warrant for your home.

How long between DUI offenses does it count as a repeat?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
The length of time between DWI makes no difference as to the level of charge. A third, 4th, 10th, etc. is a felony.
