If a person is suspected of shop lifting, then reasonable steps can be take to detain the person. If the person is not detained, they could still be charged with shop lifting. It would be a matter of proving the offense as to whether there is enough to go forward or be convicted.

They can elect not to pursue criminal charges, and it sounds like that maybe the option they chose. They can demand a civil penalty which is separate from the criminal case. If you get a civil demand letter in the mail, that is probably what that is.
