What will happen to my husband can he get the five years?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
Depending on the court, it may be possible to reinstate his probation. Have his attorney contact the probation officer with the court to see what the policy is in that court. Some courts leave the decision to the probation department, others to the district attorney, others defer to the judge only.

In a shoplifting incident, in 1985 when filling out paperwork - do I list it as a conviction.

You need to know how the case was resolved before you can properly answer the question. Go to the County Clerk's office for the County where you were charged. Call or go in person and ask them how to get a copy of your criminal background. When you get it, see whether it was in fact a successfully completed deferred probation. An adjudication would mean that you did not successfully complete the deferred probation. If you were adjudicated, then you have a conviction. If you successfully completed the deferred probation, then you do not have a conviction.

How do I get firearm ownership if I have a previous case of embezzlement?

Answered by attorney Gregory J. Straub (Unclaimed Profile)
Criminal Law lawyer at Elmbrook Law Offices, LLC
As a convicted felon, you will not be able to possess a firearm. The only two possibilities that would allow you to possess a firearm would be a pardon by the governor or to have the case reopened and the charges reduced to a misdemeanor. Otherwise, with the felony upon your record, you will never be able to possess a firearm.
