If you received a citation for being drunk in public and failed to appear in court on the date and time indicated on the citation then you will most likely have a warrant for your arrest. In California, Penal Code Section 647(f) makes it a misdemeanor to be under the influence of alcohol and/or drugs in a public place if you are unable to exercise care for yourself or others. Failure to appear in court on a misdemeanor criminal charge will result in a warrant for your arrest. I suggest you immediately contact an experienced criminal defense attorney to discuss going into court and recalling the warrant on your behalf. I would caution you against trying to recall the warrant on your own without first consulting with a criminal defense lawyer.

Harassment is defined however the victim says it is. It is in the eye of the beholder, reasonably defined as whatever is done to annoy, threaten, etc. The ONLY specific advice you should expect to get from here or elsewhere is to exercise your 5th Amendment rights to SHUT UP, and hire an attorney to speak for you. If the victim is simply seeking a restraining order, you have the right to oppose it in court, by timely filing appropriate pleadings and attending the hearing to argue against it. You should do so, because a restraining order has negative consequences on your record similar to a felony conviction. You lose your firearms rights, and most employers will view you as a potential problem. If the victim is pressing criminal charges, you face potential jail time, and most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative'. There is no magic wand to make this go away. Prosecutors don't take the time to research, prepare and file charges just to drop them. So, if they file, youd better take it seriously. In either case, unless you know how to effectively represent yourself in court, hire an attorney who does. If this is in SoCAL, and youre serious about hiring counsel, feel free to contact me.

If a judge sentenced you to jail and did not place you in custody at your sentencing, I am almost positive you agreed to a Cruz waiver. The significance of a Cruz waiver protects the plea agreement that was made between your attorney and the district attorney. If the judge goes outside of this agreement, you can withdraw your guilty or no contest plea. However, if you do not show up to either your sentencing or turn yourself in on time, the judge theoretically can go back and sentence you to the maximum. Now, if you are on probation for a dui, and you are being re-sentenced because of a Cruz violation, you could be sentenced to the maximum of your probation case, and the maximum of your current case.
