Can the prosecution call a hostile witness in a criminal defense trial?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
The accused can never be made to take the stand in their own trial. That decision is up to the defendant and the defendant alone. If the accused is also a witness in another case and another trial, then the prosecutor can call that person to the stand. The prosecution can subpoena anyone except the accused.

Can I sue the person who provoked a fight that caused someone to die?

Answered by attorney Jonathan S. Willett
Criminal Law lawyer at Jonathan S. Willett Attorney at Law
You may be able to sue only if you are a direct relative of the deceased. If you are a relative of the accused, you do not have what is called "standing" to sue.

It's more than obvious that you should contact the local bar association and/or the State bar association to request assistance. Fee arbitration is one of their main functions.
