Should I tell the officer who contacts me that the details of the allegations are false, or should I just let my attorney handle it?

Answered by attorney Steven Fairlie
Criminal Law lawyer at Fairlie & Lippy, P.C.
Let your attorney handle it. It is a major mistake to talk with the police unless your attorney has advised that. You may have some great defenses here, such as if you were living there then you may be a tenant whom he would have to evict. Thus, you may have had a legal right to enter the premises.

What is the procedures during the hearing of a misdemeanor case?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
The first hearing will be an arraignment, at which you will plead not guilty, and if you qualify for the public defender, they will be appointed. Next there are pre trials every month, until the case is either settled or ready for trial. Get an attorney or the public defender. This is not something you can do without professional advice.

How do I get my drivers license if I had a DUI twenty years ago?

default-avatar
Answered by attorney Craig W Elhart (Unclaimed Profile)
Criminal Law lawyer at Craig W. Elhart, PC
The first step would be to file another request with the Secretary of State. This should result in a hearing. At the hearing you would have to present evidence that you should be granted a driver's license. If the secretary of state denies the license, you may be able to appeal to the circuit court. An attorney may be helpful as they would understand the procedure, however, you can always represent yourself.
