The state can amend the charge if the facts and circumstances permit. But it will be going on the original police report and the charges would depend on the facts stated therein. So, you could be charged with something else, like DUI, but it is improbable.

It is never too late because there is no statute of limitations or deadline for filing criminal charges. On the other hand, the police may take it less seriously because you have waited so long. Also, any injuries that the police might have observed may have healed by now.
