Hi, I presume the 16 year old was issued a Desk Appearance Ticket (DAT) if the police were called and a court date was assigned. This means that the 16 year old WAS ARRESTED. He/she was not remanded to Rikers (held with or without bail) but they were in fact arrested. Going forward, if a job application or license asks if he/she has ever been arrested, the answer is "Yes."  All of that being said, they will likely give the kid an ACD or violation. Neither are crimes and neither will leave the offender with a criminal record. An ACD is an Adjournment in contemplation of dismissal. It means if he/she stays out of trouble for 6 months, the case will be dismissed. If however, she/he gets arrested again within 6 months, they are in serious trouble. A violation is usually more financially detrimental than anything else as it normally comes with a fine. However, it is much like a parking or traffic violation where the ultimate impact on your life is minimal and again, it is not a crime.  If she/he is being charged with a misdemeanor, an attorney will be assigned to the case upon appearing at the court house. Did you plead guilty; were you convicted after trial. You may be able to file a Criminal Procedure Law 440 motion. Did you have access to the video before? Representing yourself is not a good idea.
