What happens if I was caught stealing for the second time and I already had a misdemeanor from the first time I was caught?

With each subsequent offense, the likelihood of doing jail time becomes greater. It will also depend on what the prosecutor is asking for and what your judge is likely to do in this type of scenario. Consult with an experienced criminal attorney in your area for a thorough review of your case and evaluation of your options.

You will robably get some form of probation and fines. Get a lawyer to make the deal. If you plead guilty with just the prosecutor even thouigh he's a nice reasonable guy, they will wreck you.

Those are your only two choices. My advice to you is to hire an attorney to help you. He/she may be able to resolve the matter without it becoming a permanent part of your record.
