The attorney is able to appear pursuant to penal code section 977 without you in a misdemeanor or infraction court. If it is a felony, you will likely have to appear in court with the attorney. Otherwise, you will be able to brave it alone and explain the situation to the court. Courts are usually forgiving in cases like this.

I don't know. Do you have any reason to rear a CPS investigation? If you do, then your problems are bigger than $400.00. You give him the $400.00, the issue with CPS is NOT going to go away. So what happens the next time he makes a similar threat but demands $500.00?
