Unfortunately, no, you cannot sue the officers for not giving you any warning. Really, all you can do in this situation is to deal with the evading case. There may be some things you can do to potentially avoid a conviction on your criminal record for that charge, but any lawyer would have to know some more about the facts before telling you for sure.

Possibly. It depends on your history on these matters, your intent at the time you took the money, etc. You should do your best to get the money to continue the work. (You could be charged with a theft related issue if you took the money and didn't spend it as you agreed to do.)

Generally, you don't have any right to view the video while the case is still being investigated. They may show it to you to coax a confession. They may just tell you the video is definitely you. Beware: the cops don't have to tell you the truth about the clarity of the video. The best advice any attorney can give you is to stop cooperating with them. If they think it's you, there is virtually nothing you can do to help yourself, by talking. The best thing you can do for yourself at this point is to invoke your 5th Amendment right to be silent. And yes, if they feel they have probable cause to arrest you for the alleged crime, they can be calling you to the station for no other reason than to arrest you, with or without the confession.
