If someone is acquitted of the great charge can they be charged with lesser included in Florida

David William Olson
Answered by attorney David William Olson (Unclaimed Profile)
Criminal Law lawyer at The Law Offices of David W. Olson
If the lesser included offense is entirely within the charge for which the acquittal was entered, no further prosecution can occur as to the lesser offense.   That is because of the Constitutional protection against being tried twice (the Double Jeopardy clause). The fact that he was never indicted as to the lesser offense does not change this prohibition.

I’m 16 and got charged with a class B misdemeanor for $200 worth of items what will be my consequence?

California doesnt separate misdemeanors into classes. California only has 3 levels of severity for crimes - infractions, misdemeanors and felonies. There is no such thing as a "Class B" misdemeanor. If this was in another state, you should contact an attorney in that state since criminal law differs from state to state.

You should have gotten the anger management assessment long ago. You will probably face a violation of probation for not doing what was required, and will need to hire an attorney.
