The fact that restitution is made does not negate the crime, although it may have something to do with the severity of the punishment. When in doubt, take the money and let the other chips fall where they may.

No, stop looking for something for free. You go into a store and drop off a ring. The person behind the counter takes the ring to his home, for who knows what reason. No one denied ever taking the ring out of the store. Was the ring repaired? Yes, and you want to know anout larceny for what reason. If the employee took the ring home to try and look at the damage to the ring, because the store was about to close, or he had better equipment at home to examine the ring, would you think he did something wrong. Write back in 10 years and tell me if you are still married. People that calculate only the negative have a way of being alone in the end.
