You can either send him a certified letter (or perhaps Priority Mail with delivery confirmation, or Fed Ex, etc.) making a demand for a substantial refund for all of the reasons you cite below, or you can hire another attorney to write him a letter to make the demand on your behalf. The lawyer is not permitted, however, to make a threat to go to the State Bar if he does not comply. His threats of harassment are inappropriate and not warranted. Your other option is to simply write to the State Bar to file a complaint.

Here are the rules: There is no time limit for class A felonies. For all other felonies the time limit is five years. For misdemeanors the time limit is two years and the time limit is one year for violations. There are no time limits on warrants.

If you can't afford a private attorney, a public defender will be appointed at your daughter's first court appearance (the arraignment). She will have to opportunity to talk with the PD about her options and possible defenses. Most counties offer some sort of diversion for first-time shoplifters if the value of the goods was less than $50 and there was no violence used during the theft.
