How do I get firearm ownership if I have a previous case of embezzlement?

Answered by attorney Gregory J. Straub (Unclaimed Profile)
Criminal Law lawyer at Elmbrook Law Offices, LLC
As a convicted felon, you will not be able to possess a firearm. The only two possibilities that would allow you to possess a firearm would be a pardon by the governor or to have the case reopened and the charges reduced to a misdemeanor. Otherwise, with the felony upon your record, you will never be able to possess a firearm.

What is the law in Texas regarding vulgar or threatening phone calls?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

You can call the police but a single call like that is not likely to result in charges. To be harassment, it must be multiple calls. To be a terrorism threat, it must be a threat to do bodily harm imminently. Those do not apply as you have described.

Statute of limitations of 2 years for Misdemeandor

Matthew Kyle Simcox
Answered by attorney Matthew Kyle Simcox (Unclaimed Profile)
Criminal Law lawyer at The Simcox Law Firm, P.L.L.C.
In Texas, ALL misdemeanor cases (classes A and B) have a 2 year statute of limitations.  That time period can be tolled (that is, stop running) if it can be proven that the defendant left the state and set up residence elsewhere.  It continues to run once the individual returns to the state.  As with anything else, the State has the burden to prove that there is a reason for the statute of limitations to be tolled.  Yes, terroristic threat is a 2 year statute of limitations. I hope that helps.
