We can represent you on the motion to suppress. We can represent you with regard to the criminal charges. I was the first assistant prosecutor in Ocean County. I have a partner who has been a prosecutor for 30 years. The key to success on the motion to suppress is demonstrating that the police had no reasonable basis for coming on your property and searching. We would have to determine if your spouse gave them permission to come on the premises or if she gave them circumstances which would support that a crime was being committed. I am being sentenced to a 5 year flat for a 2nd degree and 3 3rd degree assault by auto charges. How long would I have to serve of that sentence?

You would be eligible fpr parole after serving approximately one-third of the sentence, with credit for 'good behavior'. We work closely with clients and the Parole Board at the beginning of the sentence to inusre that the proper actions are taken by the client/inmate to be successful in their request for parole. Misdemeanor or felony charges. Thats up to the police and prosecutor. Youll learn the actual charge[s] filed against you when he appears for arraignment at your first court hearing. My advice to him: When charged with a felony, you potentially face one or more years if convicted; on a misdemeanor, you potentially face up to 6-12 months. What can you do? Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict. No amount of free 'tips and hints' from here or anywhere else are going to effectively help you in your defense, other than the advice to exercise the 5th Amendment right to SHUT UP and do NOT talk to anyone except an attorney about the case. That includes on this or any other web site or public forum. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. He could also be sued by the other parents for their damages and costs, and you would likely be named in the suit as well as the responsible adults. Call me for defense if that happens.
