If convicted (whether by trial or by entry of a guilty or no contest plea) your brother could face jail time regardless of any prior criminal record.  However, his prior record could impact how much, if any, jail time the prosecutor is seeking.  The circumstances, the alleged victim's background, and/or strength of the state's case could also have a signicant impact on the outcome of the case if it proceeds to trial -- or on any plea bargain if the case does not go to trial.

Go ahead, take your chances at trial without adequate counsel. The state has the ability to get a conviction even if the live in girlfriend refuses to show up and testify at trial. They will get what she said that night into evidence through the officer, probably, through an exception to the hearsay rule named "excited utterance." You really need to hire an attorney.

Does that mean you have already been guilty and are just waiting on the sentence for the PV? That is unusual as they almost always take place immediately after being found guilty. It's possible to wait up to a few weeks for a hearing on a PV but that would be at the most. If you have an attorney, have him look into the matter as to why it is taking so long if that is the case.
