You need an attorney. Contact some criminal defense attorneys in your area to see how much they would charge for a case like that. It's such a low-level type of charge that it probably wouldn't be too expensive. If you can't afford to hire an attorney, ask the court to appoint the public defender at your first court date. If you are on formal probation, you will need the permission of your probation officer before leaving the state, and in some cases leaving the county. It will be up to your probation officer as to whether or not he will allow you to travel to Cancun, and it is quite possible that he will deny your request.

There is no such law. As long as the defendant agrees to waive time, the case can drag on for as long as the judge permits.
