Will I be arrested if I missed my court date?

Answered by attorney Michael Thomas Lynch (Unclaimed Profile)
Criminal Law lawyer at Michael T. Lynch
I don't know if you will be arrested, no one does, but you can be arrested if they issued an arrest warrant when you did not appear. Typically, at least in this county, if you show good faith by making an appearance to clear the warrant, and show up with completed paperwork, the court might exercise its discretion and recall the warrant. It would depend on many other factors such as if you have failed to appear in the past, and / or your criminal history.

Was it illegal for my son to get a ticket for unopened alcohol?

Answered by attorney Joseph A Katz (Unclaimed Profile)
Criminal Law lawyer at Joseph A. Katz Attorney at Law PLC
It was not illegal, per se, except that you did not provide enough facts. I cannot understand how the officer had the right to search the trunk. That could have been illegal. The ticket itself, once you are past the search and seizure, 4th Amendment issue, would not be illegal if your son was under 21 years of age. Since the alcohol was unopened and in the trunk, though, this is a case he should most definitely fight. I think even a dismissal would be reasonable, but an infraction for disturbing the peace, at most.

How much jail time could I serve if I opt out of drug court?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
You'll get the answer to that from your attorney, who will negotiate with the DA and judge for a decision. If you entered a plea with deferred sentencing in return for the program, look at your Probation and Sentencing paperwork, it will specify the jail/prison time you were ordered to serve. The time in program does not count as credit for jail time sentenced. If you drop out, you just wasted that time. If serious about hiring counsel to help you in this, and if this is in SoCal courts, feel free to contact me.
