If someone tells the police that they don't want to press charges can the person change their mind?

It's not the victim's decision whether or not to press charges. That decision belongs to the DA. Often, the DA will take the victim's wishes into account in making that decision, but not always.

Are police required to give a translator to someone who does not speak English when they are read their Miranda Rights?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)

In order for any statement to be admissible, a person that is in custody and being interrogated must be be given their Miranda rights. Not only that, but they must be given in a way that the suspect can understand the rights before they can waive them. This is something for your cousin's attorney to look at in detail.

Can a home be searched without a search warrant?

default-avatar
Answered by attorney Mechislav Furman (Unclaimed Profile)
Criminal Law lawyer at Law Offices of Mitch Furman
Absent exigent circumstances, the police need a search warrant to search your home. If they don't have a warrant and search your house and find illegal contraband or any other items the State wants to use as evidence against you. Your attorney can argue to the court that, those illegally seized items should be suppressed.
