Is it legal for the police to conduct a vehicle search?

Answered by attorney Seth David Schraier
Criminal Law lawyer at Law Office of Seth D. Schraier, P.C.
The question here is not whether the search was "legal" but whether any of the evidence found was done so in an improper way, and is now going to be used against you. The police can legally search what they want in that you cannot have a police officer arrested for doing an improper search. Now if the drugs found were illegal, and the police now intent to charge you with a crime, the evidence found could not be used against you to charge you with the crime as it was found in way that violated your 4th Amendment Rights.

How long can you be kept in county jail if you violate probation?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
As far as I know there is no magic timeframe, but if you have not gotten into court in at least a couple of weeks, have a lawyer check with the judge's office to see what is going on. If you are there too long, you can always file motions to get a hearing right away or else be released. Seek out an experienced criminal defense attorney to assist you in such a matter.

Does he have grounds to contest the search as illegal if officer said they were looking for an insurance card?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

If the car was going to be towed, then the officer could search it before it was towed because that is policy - to help protect against theft (and against allegations against the police that they stole.)? He needs to discuss this with his lawyer.
