Can the district attorney drop charges against me?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
Have you been charged? If so, you need a lawyer to represent you. The DA can drop charges (or not file them so you might be better off to get a lawyer regardless of whether or not you have been charged.) Keep up whatever bargain you made about making restitution and finishing paying it off - the sooner the better usually (but follow the lawyer's advice first.) You might also want to contact a bondsman to keep a lookout for a warrant so you can make a non arrest bond.

When filling out an application that asks if I have ever been convicted of a misdemeanor how do I answer if my case was dismissed?

Luke Aaron Williams
Answered by attorney Luke Aaron Williams (Unclaimed Profile)
Criminal Law lawyer at Howard Lotspeich Alexander Williams, PLLC
If you were placed on deferred and successfully discharged, the you would have no conviction and could answer "no". But, you would need to make certain that the deferred has been discharged and the dismissal was signed by the judge.

Is a felony conviction a reason for not being accepted at a police academy?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

Uh, yes. I am not bothering to research the answer about whether you qualify legally or not because you will not be hired as a police officer with a felony conviction. If you were testify in a criminal case in which you made an arrest as a police officer, the defense would be entitled to impeach your testimony with your conviction - and that is not going to be happening. Only way you can get rid of the conviction is to get a pardon which almost takes a miracle in Texas.
