If it is in California and it is charged as a misdemeanor, you can hire a private lawyer to appear for you. If it is a felony, you will have to make an initial appearance but a private lawyer can submit a 977 waiver for your appearance for future court events. The charge you listed can be either felony or misdemeanor but is usually charged as misdemeanor unless there are egregious circumstances.

The arrest is a violation of your probation and an affidavit of violation will be submitted which will be followed by a warrant for your arrest. Get counsel in FL on this swiftly, the sooner the better.

Maximum Time for a Misdemeanor VOP?

The maximum on any VOP is the maximum on the underlying charge, less any time already served on that particular charge.  On a domestic battery, misdemeanor, the max is 1 year county jail.  On a first time petit theft it is 60 days but on a second or more petit theft it is one  year, with the exception that a fourth petit theft could have been filed as a felony.  But if it was not, the max is a year.  So, to get to three years there must be 3 charges she violated on.
