Police officers are not required to read anyone Miranda warnings. These are ONLY required when a police officer wants to question someone who is in custody. If they don't want to question someone in custody, they do not have to read the Miranda warnings. When the police violate a person's rights by failing to read Miranda warnings, the defendant does not go free; rather, the person's statements cannot be used against them.

If you have misdemeanor convictions in Missouri, you should contact an attorney licensed in the state where the misdemeanor convictions happened and tell that attorney what those convictions are and then they can tell you if they qualify for expungement. There is a very short list of misdemeanors that qualify for expungement in Missouri. If they do qualify, you can hire an attorney to go to court and ask the judge to expunge the convictions.

It is possible that some graduate school may look at this history as a disqualifying factor. Therefore, the best thing to try an do would be to try withdraw your plea and seek a "deferred" judgment. A deferred judgment, if completed successfully, would result in dismissal of the case. After that, you may have your record "sealed."
