Typically, with no prior record, a plea agreement can be worked out without the need for jail time. However, every case is different. Should you go to trial and lose, your chances of jail time to up.

Can someone be charged if they overdose on an illegal drug?

Answered by attorney Vanessa J. Gorden
Criminal Law lawyer at GordenLaw, LLC
This is a situation falling under medical privilege. The doctor is not going to report the person to police without other reasons (if person has a crck baggie with them, they might get charged with possession, for example). Society values people getting medical help and being truthful with their doctors.

You can hire a new attorney. Two months should be enough time to get up to speed and be prepared for a preliminary hearing in most cases.
