Can your entire check be used in a criminal case that has a set amount to be paid every month?

Mark Corwin Bruce
Answered by attorney Mark Corwin Bruce (Unclaimed Profile)

Under California debtor rules, only a percentage of your pay can be used to repay a debt. I would go back to court or contact whoever is in charge of restitution and ask if the monthly amount can be reduced so that you can have a living wage.

If police came for a domestic dispute and they take a statement and leave, will that come up on your record?

The police will make out their report and submit it to the prosecutor who will then decide whether to file charges. If charged, your husband will probably receive a notice to appear in court probably through the mail. Don't hide from the mail because if it is mailed out and he ignores it or pretends he never received it, a warrant could issue.
