I do not understand your question, but if the preliminary exam goes for without the prosecution having all of its evidence in order, it is to your favor. I would engage in attorney immediately to determine whether or not you can gain some advantage from this situation.

You may not be arrested, but you can still be criminally charged. Even if you returned the property and paid the civil restitution. You can still be charged criminally. That is up to the prosecutor, not the police or the store.
