If my miranda rights weren't read what happens?

default-avatar
Answered by attorney Eric E Rothstein (Unclaimed Profile)
Criminal Law lawyer at Rothstein Law PLLC
The police only have to read you your rights if you are both in custody and being interrogated. Failure to read someone their rights results in suppression of the statement not dismissal of the case. There may be a way to get your case dismissed. Feel free to contact me if you are looking to retain a criminal defense lawyer.

Can I sue the person who provoked a fight that caused someone to die?

Answered by attorney Robert Conover English (Unclaimed Profile)
Criminal Law lawyer at The English Law Firm
Technically, you can sue the person, but it does not sound like it is likely to be successful. If there was any credible evidence that the fight was caused by the other party, then your grandson would have had a defense to his criminal charge. He was convicted beyond a reasonable doubt, so I don't think a civil suit would have any realistic chance.

What happens if I accidentally missed a court date for a DUI?

First, you should ask your attorney.. If you do not have one, you should consider hiring one. Often times, an attorney can help with this situation and you can avoid an arrest that is inconvenient and embarrassing.
