Do I need an attorney to turn myself in for a bench warrant?

Answered by attorney Matthew M Friedrich (Unclaimed Profile)
Criminal Law lawyer at Law Offices of Matthew M. Friedrich, P.L.L.C.
I believe it's always safest to appear with an attorney. It demonstrates your commitment to the case and the idea that you will appear for future court appearances and will defend yourself accordingly. Judges and magistrates know that you've made a personal and financial commitment to the case and, consequently, they are more likely to give you a more reasonable bond when you appear with retained counsel. Beyond that, it helps to have someone who can analyze the case and evidence with you, appear with you and speak for you at all court appearances, and give you advice and guidance on how to handle the case and how best to resolve the matter. If your goal is keeping a conviction off of your record, that is something an attorney will try to help you achieve.

How do I get my vehicle safely and legally?

Answered by attorney David C. Ayer (Unclaimed Profile)
Criminal Law lawyer at AyerHoffman, LLP
The situation you describe is most likely a civil matter, not a criminal one, therefore the police will be of little help. If the seller has filed suit against you, you should retain an attorney immediately to both defend you against the suit and file a counterclaim against the seller based on his failure to deliver the truck. The exact details of both your defense and your counterclaim will depend on specific facts of the situation. You may have a claim for breach of contract, unfair and deceptive business practices, fraud, or other claims.

What should I write to the judge to remove my warrant and what will happen next?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
The clerk told you nonsense. You cannot write to have a warrant recalled. You can only write to get a court date to request a hearing. At the hearing, IF you are unsuccessful, then you will be arrested on the warrant.
