IfI have a pending felony case can I travel?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
Most felonies require the posting of a bond or pr bond. Very rarely do felonies get summons. Unless you got a summons, your bond conditions likely require you to get permission from the court prior to leaving the state or country. This almost always requires getting permission from the bondsman or whomever posted the bond. You need to contact the court to get permission. If you do not, and they find out, then you are in violation of your bond conditions. That is a felony charge with a mandatory 1 year in prison, if convicted.

How do I retain new "FREE" council on my drug case?

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Criminal Law lawyer at Miller & Harrison, LLC
I can assure you that no lawyer would keep a case if there was a real conflict as they would not want to jeopardize either client, nor put thier law license at risk.   If the Court appointed this lawyer, and you do not want him as your lawyer, really your only option is to hire your own (I realize you may not financially be able to if you qualified for a court appointed lawyer). I would trust the lawyer you have.

What is the sentence for someone with sexual abuse and no previous records?

Answered by attorney Jacob Thomas Erickson
Criminal Law lawyer at Smith, Paulson, O'Donnell Erickson, PLC
The penalty for a sexual abuse claim will depend on what level of criminal sexual conduct the person is charged with. A person with no criminal history can expect to be sentenced to twelve years in prison if he or she is convicted of a first degree criminal sexual conduct. Sentences for lesser levels of criminal sexual conduct would be measured in months or even days. Hearsay relates to a type of evidence that a party might try to present to the Court and only effects the likelihood that the State can or cannot obtain a conviction for the selected charged level of criminal sexual conduct.
