Could charges be dismissed due to wrong information on the report?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
It is possible that you could move to dismiss based upon such deficiency in the information or complaint. But don't get your hopes up for three reasons because 1) the judge could decide that errors aren't bad enough to warrant a dismissal, 2) the judge could allow the prosecution to amend the complaint and make the corrections, or 3) even if the case is dismissed because of this, they can always re-file against you with the correct information.

Will passing a drug test by my employer help me get out of a possession of marijuana charge?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Criminal Law lawyer at Francis John Cowhig
Being in possession of drugs and using drugs are two distinct things. The fact that you passed a drug test does not automatically invalidate the fact that you may have been in possession. If you are presently facing criminal charges for possession, I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze you case and advise you of your options.

Can a case be dismissed if I was not read my Miranda rights?

default-avatar
Answered by attorney George Martin Derieg (Unclaimed Profile)
Criminal Law lawyer at The Derieg Law Firm
Miranda protects you from incriminating yourself. When a person is detained, he/she must be read the Miranda rights, so the person understands their rights, and most helpful, so they do not incriminate themselves. The problem with your case is that we don't know what you were arrested for. If the only evidence against you is your incriminating statements, and IF those incriminating statements were made in violation of your Miranda rights, then yes, your case should be dismissed. It's just very rare that the only evidence against a criminal defendant is their own incriminating statements.
