If you are driving on a suspended license, you can be convicted of a misdemeanor. It is punishable by up to 93 days in jail, up to 2 years probation, points on your record, financial responsibility fees, court fees and costs. As a practical matter, it is not likely that you will go to jail if this is your only DWLS. If you are a repeat offender, then it may be dramatically different. You should get an attorney and you should take steps to immediately reinstate your license so that it is not suspended. If you do these things, the result could be dramatically better than not having an attorney and not getting the suspension lifted.

This is a tough one. Technically a CSC conviction, I believe is not allowed an expungement or to be set aside. However, I have handled several cases similar to what you seem to be outlining where the offender may have been young, say 17 and his girl friend, etc was 15 or younger (younger than the age of consent) and a criminal conviction entered. They subsequently marry, have children and go about their life, but the criminal conviction remains on his record. Assuming you don't have any other criminal convictions which would hamper the process, there is a possibility based upon the cooperation of the prosecution to set aside the conviction. Once again, there is no promise and it depends upon many factors but it has been done.

The court system and criminal procedure are very difficult avenues to navigate without experienced help. As much as you would like to proceed without an attorney or believe you cannot afford one, it is very difficult, if not impossible, to successfully defend yourself without someone who is trained and experienced in doing so. If you cannot afford an attorney, the court would probably appoint you one. It sounds like you may have a valid defense and it would be in your best interest to have an experienced criminal defense attorney from your area representing you and your interests. Only the prosecutor can decide to dismiss a case. There may be issues with your case that can be used as leverage when negotiating with the prosecutor which is another reason why having experienced criminal attorney represent you is very valuable.
