Is it legal for a 20 year old to have sex with a 17 year old even if the parents don't approve of the relationship?

Answered by attorney Ronnie Ismael Vargas (Unclaimed Profile)
Criminal Law lawyer at Velez, Moreno & Vargas, LLC
In Wisconsin, if a minor is 17 years old and engages in sexual conduct/activity with an adult, the parents of the 17 year old could not file a complaint with the police requesting that charges be filed against the offending adult unless the 17 year old also wished to press charges against that particular adult. This is not the case if the minor is 16 or younger. In those instances, the parents of a minor can request that charges be filed on behalf of their child regardless if their child did not want to press charges against the adult with whom they willingly or unwillingly engaged in sexual activity/conduct. In short and to answer the question, it is illegal for a 20 year old to have sex with a 17 year old but the parents alone could not get the 20 year old criminally charged.

In Texas is the smell of pot enough to get a search warrant

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
It depends. The fact that you guys were in a camper creates some interesting legal questions. The reason is this: if you're in your car, and a cop smells pot, that is enough for them to search the car. If the same cop smells pot outside your house, that's not enoough to search the house. So, the answer turns on the use to which the camper is put to. The fact that there was a report of a suspicious vehicle is also a fact that goes towards a finding of probable cause. A good lawyer can file something called a Motion to Suppress, and seek to keep out any evidence they found on the basis that they did not have enough probable cause to get that warrant.

What can I do if I was charged for a burglary while I was under heavy medication?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You definitely have a defense. You must have the intent to commit burglary. However, a DA is not going to listen to you. You need to hire counsel asap and fight this with everything you got.
