What can happen to me if this is my first offense ever on my record?

Answered by attorney David Richard Kirshenbaum (Unclaimed Profile)
Criminal Law lawyer at Kirshenbaum & Goss, Inc., P.S.
There is a possibility that you may be able to avoid a conviction on you first offense. Some jurisdictions will allow the case to be continued for a period of time on certain conditions. if you meet the conditions, the case is dismissed. Some jurisdictions will give you a deferred sentence. On a deferred sentence you are found guilty, but that finding can be set aside, if you meet certain conditions, and a finding of not guilty be entered and the case dismissed. It is also possible that a finding of guilty will become part of your criminal record. If you are convicted and you meet all of the conditions of your sentence, you may be able to get the conviction vacated. The important thing, is that you never get yourself in this position again.

If my case status goes from pending to closed, does that mean my probation is over?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
Not necessarily. Check the terms of probation paperwork that you received from the court when you were placed on probation. It will specify the length of your probation. If there was an agreement that your probation would terminate upon full payment of restitution, then that too will be specified there.

What happens when a minor gets caught smoking weed at school and has a pipe on them?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
This is usually a Minor in Possession type charge. Depending on the jurisdiction and your prior record, they will likely give you a deferred sentence or deferred prosecution offer. This means that if you complete the conditions, the case will be dismissed and able to be removed from your record. The conditions are often a drug/alcohol class, 24 hours of community service, stay out of trouble and some fines. If you have a drivers license, then a conviction will cause you to be suspended for 3 months. You would get this information in the mail from DMV and there will be directions as to getting your drivers license back. MJ smells and so smoking in doors will attract attention. It also stays on your clothes for a while. So, if you are going to smoke, you need to do it in a well ventilated place - outside on a mildly windy day. Do not smoke and drive - dangerous.
